Gold prices, commodities fall on China weakness

Gold prices drop more than $20 an ounce. Copper, oil, and soybean prices also decline as concerns mount about an economic slowdown in China. Gold prices close below $1,650 an ounce.

Commodity?prices?fell broadly Tuesday as more evidence of China's slowing economy renewed concerns about future demand for everything from oil and copper to soybeans and gold.

Housing?prices?dropped in 45 Chinese cities in February, partly because of government measures to ease property speculation. China also raised the?price?of gasoline for the second time in two months, which could diminish demand.

BHP Billiton Ltd., the world mining giant, also predicted that China will not consume much more iron ore in 2020 than it does now. Demand increased more than fivefold between 2000 and 2012.

China has been a major buyer of iron ore, which is used in steelmaking, as it has ramped up infrastructure projects like roads, airports, factories and housing.

News that affects the pace of China's growth can have a significant impact on commodity?prices?because China is a major importer of raw materials to drive the world's second-largest economy.

China's rapid growth has slowed in the past year because of government measures designed to prevent the economy from overheating. Its economic growth was 8.9 percent in the final quarter of 2011, compared with double-digit expansion the previous year. The government has set a growth target of 7.5 percent for 2012.

The developments from China gave some commodities investors a chance to sell holdings for profits, Kingsview Financial analyst Matt Zeman said.

"I don't think we're going to see any real broad sell-off," he said. "I think that people are going to look more at these little pullbacks as buying opportunities than anything else."

In metals trading, the?price?of copper was held down by a mixed housing report. The Commerce Department said builders broke ground on fewer homes in February but obtained more permits to build homes later in the year.

Copper for May delivery fell 7.85 cents, or 2 percent, to finish at $3.8305 per pound, and silver fell $1.121, or 3.4 percent, to $31.834 per ounce. April platinum fell $30.40 to finish a $1,654.30 an ounce and June palladium dropped $10.55 to $697.05 per ounce.

April?gold?fell $20.30 to end at $1,647 per ounce. Gold prices have fallen nearly 8 percent since the end of February.

Oil?prices?fell on concerns about China's economy and a promise from Saudi Arabia to fulfill any shortfalls in global oil supplies that may occur from a standoff over Iran's nuclear program.

Benchmark oil fell $2.48 to finish at $105.61 per barrel on the New York Mercantile Exchange. Heating oil fell 2.46 cents to end at $3.2367 per gallon, gasoline futures declined 0.47 cent to $3.3631 per gallon and natural gas ended down 1.6 cents at $2.335 per 1,000 cubic feet.

In May agricultural contracts, wheat fell 9.75 cents to end at $6.425 per bushel, corn dropped 16 cents to $6.475 per bushel and soybeans finished 21.5 cents lower at $13.45 per bushel.

New method for cleaning up nuclear waste

ScienceDaily (Mar. 20, 2012) ? While the costs associated with storing nuclear waste and the possibility of it leaching into the environment remain legitimate concerns, they may no longer be obstacles on the road to cleaner energy.

A new paper by researchers at the University of Notre Dame, led by Thomas E. Albrecht-Schmitt, professor of civil engineering and geological sciences and concurrent professor of chemistry and biochemistry, showcases Notre Dame Thorium Borate-1 (NDTB-1) as a crystalline compound that can be tailored to safely absorb radioactive ions from nuclear waste streams. Once captured, the radioactive ions can then be exchanged for higher-charged species of a similar size, recycling the material for re-use.

If one considers that the radionuclide technetium (99Tc) is present in the nuclear waste at most storage sites around the world, the math becomes simple. There are more than 436 nuclear power plants operating in 30 countries; that is a lot of nuclear waste. In fact, approximately 305 metric tons of 99Tc were generated from nuclear reactors and weapons testing from 1943 through 2010. Its safe storage has been an issue for decades.

"The framework of the NDTB-1 is key," says Albrecht-Schmitt. "Each crystal contains a framework of channels and cages featuring billions of tiny pores, which allow for the interchange of anions with a variety of environmental contaminants, especially those used in the nuclear industry, such as chromate and pertechnetate."

Albrecht-Schmitt's team has concluded successful laboratory studies using the NDTB-1 crystals, during which they removed approximately 96 percent of 99Tc. Additional field tests conducted at the Savannah River National Laboratory in Aiken, S.C., and discussed in the paper have shown that the Notre Dame compound successfully removes 99Tc from nuclear waste and also exhibits positive exchange selectivity for greater efficiency.

Lightheadedness Upon Standing Could Signal Heart Risk

MONDAY, March 19 (HealthDay News) -- If your blood pressure drops suddenly when you stand up, leaving you feeling lightheaded or woozy, you may be at greater risk for developing heart failure, a new study suggests.

This condition is known as orthostatic hypotension. According to the study, people with orthostatic hypotension were 54 percent more likely to develop heart failure than their counterparts who did not develop low blood pressure upon standing. This risk was reduced to 34 percent when the researchers teased out those who also had high blood pressure.

"Multiple risk factors can increase a person's risk for developing heart failure, including high blood pressure, coronary heart disease and diabetes," explained study author Dr. Christine DeLong Jones, a preventive medicine resident at the University of North Carolina at Chapel Hill. "Orthostatic hypotension may also increase this risk."

Heart failure occurs when the heart can no longer pump strongly enough for blood to the reach the rest of the body. About 5.7 million people in the United States have heart failure, and about 300,000 people die from it each year, according to the U.S. National Heart, Lung and Blood Institute.

Exactly how orthostatic hypotension could lead to heart failure is not fully understood. "We speculate that orthostatic hypotension and high blood pressure may contribute to the risk of heart failure through a similar pathway, such as through high blood pressure that happens primarily when a person is laying down," she added.

For the new study, researchers looked at more than 12,000 people between the ages of 45 and 64 from four U.S. counties. Close to 11 percent of people who developed heart failure during about 17.5 years of follow-up had orthostatic hypotension at the start of the study, compared with only 4 percent of those who did not go on to develop heart failure. This link was most pronounced among people aged 45 to 55, according to the findings, published March 19 in Hypertension.

To test for orthostatic hypotension, your doctor will measure your blood pressure while lying down and shortly after standing up. Orthostatic hypotension is defined as a drop of 20 mm Hg or more in systolic (the top number) blood pressure or a decrease of 10 mm Hg or more in diastolic (bottom number) blood pressure upon standing.

Some people with orthostatic hypotension might not have symptoms and may not require treatment. Others may experience dizziness, and others may even pass out, Jones said. "If one passes out or has severe dizziness, they should see a provider urgently."

People with orthostatic hypotension who also have high blood pressure should take steps to control blood pressure, and make sure their heart is healthy, she said.

The study authors speculated that orthostatic hypotension might be an indicator of early atherosclerosis -- a buildup of plaque in the arteries -- brought on by high blood pressure.

However, the study does not show that orthostatic hypotension causes heart failure, merely an association between the two.

Dr. Robert Myerburg, a professor of cardiology at the University of Miami Miller School of Medicine, said it is way too premature to say that orthostatic hypotension is a risk factor for heart failure based on this study.

"Orthostatic hypotension can cause unpleasant symptoms and if they lead to loss of consciousness or near loss of consciousness, it can lead to accidents, but this is not something that will lead to cardiac arrest," he said. His advice is to drink plenty of fluid if you have low blood pressure upon standing. "If it doesn't bother you or cause any significant symptoms, you don't have to treat it," he said.

Dr. Stephen Green, chief of cardiology at North Shore University Hospital in Manhasset, N.Y., agreed. "If you get lightheaded, see your doctor and they should see if you have orthostatic blood pressure, which is a common source of lightheadedness or dizziness when you change positions," he said.

"It doesn't mean you will die of heart failure if you have it, but over time, we can keep an eye on any signs or symptoms for heart failure," Green added.

Dr. Tara Narula, a cardiologist at Lenox Hill Hospital in New York City, said that anything that helps diagnose heart failure earlier could be beneficial. "This is an interesting paper, and if orthostatic hypotension proves to be a cause or leads to heart failure in future studies, we could possible identify heart failure earlier than we can now."

(AP) ? Occupy Wall Street protesters anticipate that with the coming of spring their movement for economic justice will pick up momentum, making priorities of issues as varied as the environment and the November elections.

But on Sunday, a day after police broke up a rally at Manhattan's Zuccotti Park and arrested dozens, some observers wondered whether a movement so diffuse could accomplish anything.

"I'm really grateful to be part of a generation that wants change, 'cause we should all want change," said Jennifer Campbell, a graduate student in documentary filmmaking at Hofstra University. "But I'm not sure what that change is, or if they know what that change is."

And Harlem resident Kanene Holder said the movement is broader than any one issue. "This is not a beauty pageant," she said. "We cannot homogenize this movement into one streamlined vision."

Meanwhile, police were seeking a subpoena to identify an apparent Occupy protester who they said tweeted a threat to kill police officers, spokesman Paul Browne confirmed Sunday.

The New York Post and Daily News reported a message by an apparent Occupy protester saying they won't make a difference if they don't kill a cop or two was tweeted at about 11:40 p.m. Saturday.

The crackdown at Zuccotti happened late Saturday after hundreds of activists had gathered to mark the sixth-month birthday of the movement.

"There was a lot of silliness and just kind of singing and dancing and really very jovial," said Chris Casuccio, who works for a nonprofit organization. "We had some banners up. There was one tarp that was up but it was tiny. It could fit like five people under it."

But Detective Brian Sessa of the NYPD said protesters had started breaking park rules against setting up tents and tarps.

Police said 73 people were detained. It was unclear how many were still in custody late Sunday.

More than 70 people gathered at Union Square Park in lower Manhattan Sunday night and were still there early Monday morning.

Occupy activists said the officers moved in with little warning Saturday and beat some protesters. Police said Sunday they had no information about any protesters being injured.

"They just came in swinging batons," said protester Sandra Nurse. She said a woman began having a seizure and another protester's head was "smashed into a building window."

Casuccio said protesters had little time to leave Zuccotti if they wanted to avoid arrest. "They gave us one quick warning and then just came in, hundreds of people," he said.

Police responded to a request seeking a response to the accusations of brutality by releasing a video that they said showed Cecily McMillan, 23, elbowing a police officer in the face as she is led from Zuccotti Park.

The woman was taken into custody and sent to Bellevue Hospital for psychiatric treatment, police said.

A group of council members from New York City were planning a news conference on Monday to denounce what they said was excessive force used by police on the protesters.

As cleaning crews used hoses to erase all signs of the clash on Sunday, Occupy activists offered differing perspectives on where the movement is headed.

"We're going to keep going," said Christopher Guerra, who has spent many nights at Zuccotti since the movement started last Sept. 17. He added, "It's going to get interesting during the election cycle. We're going to be more of a presence in the political world. I know we have a couple of people running for office."

According to Mother Jones magazine, 10 candidates for House and Senate seats in the November elections have made Occupy part of their campaigns. They include Massachusetts Senate candidate Elizabeth Warren and Hakeem Jeffries, who is running for Congress in Brooklyn. But some Occupy supporters consider themselves anarchists who abjure electoral politics.

Nurse, a member of Occupy's direct action working group, said she expects college students will have "a huge role to play this summer organizing around student debt." She noted that the issue resonates both with students and with their parents and has the potential to broaden the movement.

Ted Schulman, an Occupy protester who lives near Zuccotti, said his focus is the upcoming United Nation Earth Summit in Rio de Janeiro. He said he wants to "challenge the U.N. on what their vision of a green economy is."

Tourists streamed by Zuccotti on their way to the nearby World Trade Center site on Sunday, and some said they were not familiar with Occupy Wall Street. "We're from Colorado," a teenager in a tour group explained.

Brian Cummings of Columbus Junction, Iowa, said he did know about it.

"I understand the Occupy movement," Cummings said. "I understand a lot of people's frustration. I'm not sure how effective it is. ... Nothing seems to be being accomplished."

Immigration Options for DREAMers under EXISTING Law : Nation of ...

DREAMER shirt.jpgLast week marked the end of the second annual National Coming out of the Shadows Week, a rite of passage for undocumented youth -- Americans in all but the eyes of the law -- who support enactment of the DREAM Act.?

Publicly proclaiming one's unauthorized immigration status is clearly a courageous act. As the National Immigrant Youth Alliance explains in its "Guide to ?Coming Out? for Undocumented Youth," revealing to others that?you live in this country without legal status can range from "easy to very hard" depending on the way it's done.?An act in defiance of governmental authority, "coming out" can trigger serious repercussions under the immigration laws, including arrest, detention and deportation.

On the other hand, this form of self-revelation can be cathartic and possibly beneficial.? Counterintuitively, the first step from darkness could also set the stage for actions under current law that may well lead the federal government?to grant legal benefits and protections unavailable to other DREAMers?who remain in the shadows.? Some of these avenues are described in a useful 73-page online resource,?"The Life after College Guide for Undocumented Students," published by the nonprofit, Educators for Fair Consideration (E4FC).?

Funded in part by benefactors from Silicon Valley, E4FC suggests, for example, the possibility of seeking employer sponsorship for an H-1B visa (for Specialty Occupation Workers),?traveling abroad?and applying for a "D3" waiver under Immigration and Nationality Act (INA)?? 212(d)(3).? This is a risky proposition.? It requires throwing oneself on the mercy of both?a U.S. consular officer (who must recommend the D3 waiver) and the?Department of Homeland Security's?Admissibility Review Office (ARO) -- a unit of U.S. Customs and Border Protection -- which must approve it.? If the waiver is not granted, a DREAMer who'd entered illegally or been in the U.S. in unlawful presence?after age 18 would be subject in most cases?to a ten-year bar on reentry to the United States.

The E4FC guide also discusses various legal ways of earning a living in the U.S. notwithstanding undocumented status, such as qualifying as an independent contractor, either as a sole proprietor or an incorporated entity.?Although E4FC does not cite legal authority, it exists in some situations under Bhakta v. INS, 667 F.2d 771 (1981); Lauvik v. INS, 910 F.2d 658 (1990); and Konishi v. INS, 661 F.2d 818 (1981),?cases holding?that management of?a business?which will likely create jobs for American workers does not constitute unauthorized employment under the immigration laws.??

The guide, quite correctly however, cautions DREAMers:?

It is your responsibility to determine whether you may legally pursue these options based on your immigration status. Be sure to consult with an experienced immigration lawyer first.

The E4FC, also laudably, provides links to a free, online service gain a preliminary assessment of whether legal remedies may exist in a particular individual's unique situation, offering the admonition:

This service should only be used for a preliminary analysis of your possible immigration remedies. We urge you to consult with a reliable immigration attorney for a comprehensive analysis.??

I echo the same cautionary note as E4FC with a disclaimer here, and a reminder that?what I am about to suggest?is made available?for educational purposes only, not to provide specific legal advice.? For legal advice in each individual's case, DREAMers should consult a competent immigration lawyer, as urged by U.S.Citizenship and Immigration Services (USCIS)?here?and as explained by the American Immigration Lawyers Association in this FAQ.

With?the foregoing?very large caveat, here are some additional tips, possible?options and information for further research with and through your immigration lawyer?that may be helpful and suitable in a given case (yet may fail miserably in other cases).

  1. Build Your Tribe.??No DREAMer should face the federal government alone.? Besides a competent immigration lawyer, your tribe of supporters and resource providers should include,?whenever possible, family, friends, fellow students, community activists, faith-based groups working for social justice,?wealthy benefactors, an employer willing to sponsor you for a work visa, social media mavens and sympathetic journalists to tell your story to the public and follow you through the immigration process. Though the government may deny that publicity has any effect on their actions, publicity helps.? Paraphrasing Hillary Clinton (even if she didn't say it first?or quite this way), "it takes a village to raise a [DREAM]?child."
  2. Qualify for family-based, employer-based or self-sponsored immigrant visa classification, and apply for permanent residence (a green card) through adjustment of status by invoking the law's forgiveness provisions.?The immigration laws allow foreign citizens to obtain?"immigrant visa classification" in many different ways.? It can be obtained?through certain forms of family or marital sponsorship, or through the employment-based visa categories, including a current or prospective?employer's?labor certification, as well as through?self-sponsorship options under the "Extraordinary Ability" and "National Interest Waiver" avenues.? It can even be obtained by way of the EB-5 employment-creation investor category (say, if a wealthy benefactor provides a lawful gift, or a venture capitalist provides funds for investment by purchasing a DREAMer's intellectual property, valued?at least a half million dollars).?Immigrant visa classification can be converted into a green card through the adjustment of status (AOS) process without ever departing the United States.? As an initial prerequisite, AOS requires that the?applicant have been inspected and "admitted or paroled."??Thus, a DREAMer who entered on a visa but overstayed satisfies this?preliminary threshold.? If the DREAMer?is an EWI (someone who entered without inspection), s/he would?need to ask USCIS to grant Parole In Place?to satisfy this first step for AOS eligibility. Ordinarily, however, AOS is not available to someone who violated status or worked without permission.? Fortunately, there are two exceptions (forgiveness clauses) under which USCIS can still grant AOS: (1) If the?violation of status?was for "technical reasons;" or (2) if?it was other than through the fault of the applicant.? See my co-authored article, "Imagining the Improbable: Extraordinary Immigration Solutions for the Hapless and Hopeless." ("Imagining the Improbable").?With the help of an experienced immigration lawyer, more than a few?talented and accomplished DREAMers can conceivably present a well-proven case showing that their violation of immigration status was proximately caused by the person(s) who brought them here, or through "technical reasons," e.g., their inability as minors under law to have the legal capacity?or capability to take steps to seek some form of lawful status or discretionary relief under law.

(B) the presence of sympathetic factors which, while not legally precluding deportation, could lead to unduly protracted deportation proceedings, and which, because of a desire on the part of the administrative authorities or the courts to reach a favorable result, could result in a distortion of the law with unfavorable implications for future cases;

(C)] the likelihood that because of the sympathetic factors in the case, a large amount of adverse publicity will be generated which will result in a disproportionate amount of Service time being spent in responding to such publicity or justifying actions (emphasis added);

"Undefeated'' needs less of what we know we've seen (the football stuff) and more of the players' and coaches' lives, which even if we feel we've seen, we haven't.

What makes this a terrific film is how much we care about the players.

Courtney really does believe all that stuff about adversity and character, and the film is moving for its modest tale of boys learning to act like men.

A touching documentary that offers a field-level portrait of male mentorship, compassion and unvarnished hope - all without a Hollywood ending.

It is a powerful reminder of the difference one person can make -- and of the consequences when no one is willing to make that difference.

What lifts 'Undefeated' above other sports docs is the remarkable force of Bill Courtney's personality.

It may call to mind The Blind Side or Remember the Titans, but there's no Hollywood glitz in the blighted burg of Manassas.

The hardened inner-city kids here are far more authentic than anything Hollywood can offer, and as a result the film has a raw emotional weight that commercial features rarely achieve.

Undefeated does more to draw a straight line between the desire to win (as opposed to actually winning) and the character of a man than a thousand locker room pep talks.

At the heart of the Redigi case is what seems to be a question of first impression under copyright law: does the the copyright ?first sale? doctrine apply to the transmission of digital audio files? ?The first sale doctrine says, in essence, if you have purchased and own a work protected by copyright law, you can resell it. ?(n.b. but not if you?ve ?licensed? it, and the license prohibits resale). ?If this were not the case it would be illegal for the owners of books, records, cassette tapes, CDs and DVDs to resell them. ?Stephen King cannot complain, under copyright law, if a copy of ?11/22/63?is legally purchased and then sold and resold 50 times, depriving King and his publisher of what might have been the revenue from 50 separate sales.

However, its not clear that the first sale doctrine applies to digital recordings. ?Capitol records argues it does not, at least in the form sold by Redigi, and the motivation behind its position, at least in part, is no secret ? since you can replicate a digital audio file without limit, and every copy is identical to the original (no degradation in quality), what?s to stop someone from selling a copy and keeping the original? ?If you are the prospective purchaser of the 30th resale of a Stephen King novel, you may hesitate ? what shape is the book in? ?What, exactly, is that dark smudge on page 200? ?Whose phone number is written in the margin of page 2? ?If you?re buying a use CD you have to ask whether it?s scratched.

In the world of digital files, these concerns don?t exist ? the distinction between an ?original? and a ?copy? is non-existent. ?If you can purchase a legal ?used? copy of Thunder Road?for 79 cents through Redigi (yes, that tune is for sale (resale?) on Redigi), why pay $1.29 for it on iTunes? ?And, of course, the RIAA executives are asking themselves, what?s to stop people from uploaded and selling tens of thousands of audio files on Redigi while keeping a ?copy? that is the same, in all respects, on another device? ?Looking beyond Redigi, who knows what Pandora?s box of illegal copying may be opened if first sale permits the resale of digital recordings? ?Better to stop the leak before it becomes a flood. ?Or so the RIAA may be thinking.

Redigi claims to have an answer to the music industry?s objections objections to its service, and it is quite clever. ?Redigi advertises?that it ?has the technologies in place to ensure that once you sell a song, you no longer have access to it.? This is how ReDigi stays legit, and how you now have access to a new marketplace where rights long accepted in the physical world may now be applied to digital goods.? ?More specifically, Redigi claims that its technology (1) verifies a potential seller owns a non-infringing copy, and??(2) ensures that any items sold will not remain on their computer or synced devices, such as an iPod or iPhone. ?Of course, this assumes a certain level of?naivet??- if the seller is motivated and clever enough to move a ?copy? of the file to an unsynced device, the owner of the file can have the file and sell it too. ?Two computers will do the trick. ?However, the fact that a user may go to this extreme to game the system seems irrelevant (legally) ? Redigi is not encouraging it, and the fact that a legal product may be put to an illegal use is hardly the legal responsibility of the product?s manufacturer, as long as the illegal use is not encouraged.

Digging more deeply, it is clear that Redigi has put together an ingenious system. ?As I understand it from the various court filings (mea culpa), Redigi operates as follows:

Step One: the user establishes a Redigi account and uploads a music file to the Redigi ?music locker.? ?The user, and only the user, can stream the track on her computer. ?This act is legal under copyright law, since this kind of ?space shifting,? as its called, is protected as ?fair use.? ?Thus far, Redigi asserts, it?s in the clear. ?Moreover, in this process Redigi verifies that the file was purchased from iTunes and it is legal ? that is, it was not ripped from a cd or is itself a copy. ?Redigi fingerprints the file, so that multiple copies of the file cannot be sold on Redigi. ?And, importantly, Redigi deletes the copy on the user?s computer and synced devices, such as an iPod. ?Thus, at this point the file exists only on the Redigi servers, the ?Redigi cloud.?? If the user wants to listen to it, they must do so by streaming from the cloud.

Step Two: The user tags the track as for sale, and potential buyers are able to see that the track is for sale. ?If someone decides to purchase the track, it is re-designated in Redigi?s system as belonging to the new owner. ? Redigi does not create a new copy of the file, it simply transfers ?title? to the file on its system.

Step Three: The new owner can leave her new audio file on the Redigi server (the cloud locker) and stream it for her listening pleasure. ?If the new owner decides to download it to her computer, it is deleted from Redigi. ?A download by the new user is legal, since moving a file between the cloud and the owner?s computer is permissible.

This fiendishly clever invention has some serious brainpower behind it (Larry Rudolph, who has a PhD in computer science and has worked at MIT, Carnegie-Mellon and Hebrew University), and a patent pending.

How does Capitol respond? ?Poppycock, claims Capitol Records in its lawsit. ?To quote a Capitol court filing, ?rather than acknowledge what its service really does, Redigi recasts itself as a benign ?cloud storage? medium. ?It dissects its service into isolated components, where users upload and download songs to ?space shift? for ?personal, non-commercial? use, and ?pointers? are ?modified in the cloud? so that no copying occurs during a resale transaction.? ?In truth, Capitol argues, Redigi is an illegal ?marketplace,? and Redigi is falsely trying to recast itself as a ?cloud service.?

On another level, apart from name calling, hyperbole and accusations aimed at Redigi?s ?true? purpose (all standard stuff when it comes to lawyering, I?m sorry to say), the case is being debated at a highly technical level ? technical in both the ?computer sense? and the ?copyright sense.? ?Capitol has raised a multitude of claims, and Redigi as many defenses, but after you filter out the arguments that appear to be weak or red herrings, the central issue appears to be whether the resales facilitated by Redigi are protected by the first sale doctrine.

The law does not, Capitol argues, permit the resale of a digital file unless a material object changes hands, and Capitol assumes that electrons are not material objects.

Capital argues that the first sale doctrine permits?owners of a ?particular copy? (a ?material object?) ?in which a copyrighted work is ?fixed,? to??dispose of the possession of that copy.? ?However, the first sale doctrine does not apply to?digital?transmissions, which by their very nature do not involve the physical transfer of a material?object, or so Capitol claims. If?a digital resale can only be accomplished by?reproduction of the original file and creation of a new copy, first sale does not apply. ?Simply put, you don?t have the right to copy a copyrighted work in order to distribute or sell it to someone else, even if you destroy the original. ?When a Redigi buyer purchases an audio file from Redigi, she is purchasing a ?copy? of the purchasers file. ?The only way this would not be true is if the purchase involved the physical object holding the file. ?That, after all, is what a CD is ? a disk holding digital files. ?The first sale doctrine protects this kind of sale, whether the object being sold is on a vinyl disk, cassette tape, CD or DVD. ?It would even allow someone to sell their iPod, loaded with iTunes songs. ?But it doesn?t allow a digital transmission of a file, even if the original is simultaneously destroyed.

Many of these issues came to a head for the first time (but hopefully not the last) in early February, when U.S. District Court Judge Richard J. Sullivan heard Capitol?s motion for a preliminary injunction in federal court in New York. ?Before the hearing Google requested leave to intervene in the case, noting the ?complex and profound legal issues? raised by the case. ?Judge Sullivan denied that motion. ?However, Google made many of its point in its request letter, and Judge Sullivan undoubtedly got the message that this case is a big deal in small world of digital copyright law.

The outcome of the hearing was both good and bad for Redigi: the judge denied the injunction (which would have shut Redigi down while the case proceeded, and likely have ended Redigi?s existence altogether). ?However, he did this on the relatively narrow non-copyright-specific ground that Capitol would not suffer ?irreparable harm? without an injunction ? that is, that Capitol could recover money damages if it ultimately won the case, and therefore any injunction should await final judgment in the case. ?For Redigi, this was good. ?However, according the transcript of the hearing the judge also made comments suggesting he thought Capitol had the better case: ??I think likelihood of success on the merits is?something that plaintiffs have demonstrated.? ?This was bad.

The transcript (link below) makes interesting reading. ?The judge was prepared, and he peppered the lawyers on both sides with hypothetical questions that the lawyers sometimes had difficulty addressing. For example,?Capitol?s lawyer conceded that Capitol was not challenging the right to store a legally purchased digital recording in the cloud, if the purpose is not resale of the recording. ?In a humorous exchange Capitol also allowed that it?would have no objection to the Judge selling his iPod, loaded with recordings, to his law clerk. ??That?s fine, because you transferred the material object.? ?(Tough question since it?s hard to disagree with a hypothetical that includes the judge and his clerk).

However, based on a reading of the briefs and the transcript, it?s not clear that the judge really had a nuanced understanding of how Redigi works, or how copyright law might apply to Redigi?s system. Nothing in the transcript suggests that the judge understood that each ?step? in the Redigi process was permitted, and therefore the system as a whole may be permissible. ?Most judges and lawyers are not strong on computer technologies, and the hearing seemed to suffer from this shortcoming. ?The judge even seemed to think it was relevant that Redigi could be misused (by the ?second computer? trick, mentioned above). ?However, if Redigi doesn?t encourage misuse of the system, it can hardly be blamed for the hypothetical misuse of it, so this should be irrelevant.

The case is now scheduled summary judgment motions to be filed in by mid-July, with oral argument to follow on August 17th. ?A decision on these motions is likely to arrive sometime this Fall, and almost certainly by year end. ?Hopefully, the outcome won?t include a debate over whether an electron is a ?material object.? ?And, one hopes that should the outcome be adverse to Redigi, it will have the resources to pursue an appeal to the Second Circuit Court of Appeals, which might be more receptive to the the ?complex and profound? issues that lie at the heart of this case.

Georgetown professor co-edits new textbook aimed at improving identification and treatment referral in the primary care setting

Washington, D.C. Within the health care system, children and adolescents with mental health and psychiatric conditions often go undiagnosed.

A brand new textbook co-edited by a Georgetown University School of Nursing & Health Studies faculty member seeks to change that scenario by strengthening the relationship between advanced practice nurses who specialize in either the psychiatric-mental health or primary health care fields.

"Child and Adolescent Behavioral Health: A Resource for Advanced Practice Psychiatric and Primary Care Practitioners in Nursing" published in March 2012 by Wiley-Blackwell (ISBN#9780813807867) is an approximately 550-page resource written and peer reviewed by more than 70 nurse experts.

The co-editors are Edilma L. Yearwood, Ph.D., PMHCNS, BC, FAAN, associate professor of nursing at Georgetown and editorial board member of the Journal of Child and Adolescent Psychiatric Nursing; Geraldine S. Pearson, Ph.D., PMHCNS, BC, FAAN, past president of the International Society of Psychiatric Nurses and editor-in-chief of the journal Perspectives in Psychiatric Care, and Jamesetta A. Newland, Ph.D., FNP-BC, FAANP, DPNAP, clinical associate professor and director of the Doctor of Nursing Practice Program at New York University College of Nursing and editor-in-chief of The Nurse Practitioner: The American Journal of Primary Healthcare.

"The reality is that there are not enough child psychiatric providers to meet the burgeoning needs of the pediatric population for mental health services both in the United States and worldwide," the co-editors write in the book's preface. "Primary care is at the forefront of service provision and, as such, can play a significant role in mental health early case finding and supportive linkages to treatment."

The book is divided into four sections, including assessment, treatment, special populations, and special issues. Among the chapter authors are several NHS faculty members:

  • Kathryn K. Ellis, DNP, APRN, FNP-BC, ANP-BC, assistant professor and director of the Family Nurse Practitioner Program, co-authored a chapter on, "Collaborative Treatment With Primary Care."
  • Jean Nelson Farley, MSN, RN, PNP-BC, CRRN, instructor of nursing, co-authored chapters on, "Autism Spectrum Disorder" and "Chronic and Palliative Care Pediatric Populations."
  • Joan Burggraf Riley, MS, MSN, FNP-BC, FAAN, assistant professor of human science and nursing, co-authored a chapter on, "Eating Disorders in Children and Adolescents."
  • Sarah B. Vittone, RN, MSN, MA, assistant professor of nursing, co-authored a chapter on, "Legal and Ethical Issues."
  • Edilma L. Yearwood, Ph.D., PMHCNS, BC, FAAN, co-authored chapters on, "Child, Adolescent, and Family Development," "Mood Dysregulation Disorders," "Deliberate Self-Harm: Nonsuicidal Self-Injury and Suicide in Children and Adolescents," "Nonpharmacological Treatment Modalities: Play and Group Therapies," and "Influence of Culture/Needs of Immigrant Children."
  • Additionally, Jason Roffenbender, MS, research associate, provided research assistance for the book project.

The co-editors note that the book is intended to raise awareness in primary care practitioners, who can assess behavioral health issues and then work collaboratively with child and adolescent psychiatric-mental health nurse practitioners to make sure that all children and adolescents receive the treatment they need.

"Primary care nurses are in the unique position to have long-term relationships with children, adolescents, and their family," they write in the preface. "They can be the supportive bridge and catalyst to ensure that mental health treatment is both destigmatized and accessed."
